{"id":827,"date":"2019-01-10T10:26:05","date_gmt":"2019-01-10T04:56:05","guid":{"rendered":"http:\/\/knowledgekart.in\/blog\/?p=827"},"modified":"2020-02-13T12:46:21","modified_gmt":"2020-02-13T07:16:21","slug":"10-reservation-economically-weak-among-upper-caste","status":"publish","type":"post","link":"https:\/\/knowledgekart.in\/blog\/10-reservation-economically-weak-among-upper-caste\/","title":{"rendered":"10% reservation for economically weak among upper caste"},"content":{"rendered":"\n<div class=\"wp-block-image\"><figure class=\"aligncenter\"><img loading=\"lazy\" decoding=\"async\" width=\"730\" height=\"300\" src=\"http:\/\/knowledgekart.in\/blog\/wp-content\/uploads\/reservation-upper-caste-aarthik-aarakshan-swarn.jpg\" alt=\"10% reservation for economically weak among upper caste\" class=\"wp-image-828\" title=\"\" srcset=\"https:\/\/knowledgekart.in\/blog\/wp-content\/uploads\/\/reservation-upper-caste-aarthik-aarakshan-swarn.jpg 730w, https:\/\/knowledgekart.in\/blog\/wp-content\/uploads\/\/reservation-upper-caste-aarthik-aarakshan-swarn-416x171.jpg 416w, https:\/\/knowledgekart.in\/blog\/wp-content\/uploads\/\/reservation-upper-caste-aarthik-aarakshan-swarn-300x123.jpg 300w\" sizes=\"auto, (max-width: 730px) 100vw, 730px\" \/><\/figure><\/div>\n\n\n\n<p style=\"text-align:left\">The Union Cabinet has approved a proposal for introduction of the <strong><em>Constitution (One Hundred and Twenty- Fourth Amendment) Bill, extending 10% quota to \u201cthe economically weaker sections in the general category who are not covered by any of the existing schemes of reservation\u201d<\/em><\/strong>.<\/p>\n\n\n\n<p>The bill is designed to <strong><em>amend\n the Constitution to extend 10% reservation in direct recruitment in&nbsp; \ngovernment jobs and for admission in higher educational institutions to \n\u201ceconomically weaker\u201d sections<\/em><\/strong> among all castes and communities, Christians and Muslims included, who are not eligible under the existing quotas.<\/p>\n\n\n\n<p><strong><em>The proposed amendment Bill will define Economically Weaker Section (EWS) as one having:<\/em><\/strong><\/p>\n\n\n\n<ul class=\"wp-block-list\"><li>Annual household income below Rs 8 lakh.<\/li><li>Agriculture land below 5 acres.<\/li><li>Residential house below 1000 sqft.<\/li><li>Residential plot below 100 yards in notified municipality.<\/li><li>Residential plot below 200 yards in non-notified municipality area.<\/li><\/ul>\n\n\n\n<p><strong><em>What would it take for the quota to become reality?<\/em><\/strong><\/p>\n\n\n\n<p>It will need an amendment of <strong><em>Articles\n 15 (prohibition of discrimination on grounds of religion, race, caste, \nsex or place of birth) and 16 (equality of opportunity in matters of \npublic employment) of the Constitution<\/em><\/strong>.<\/p>\n\n\n\n<p>The amendment will have to be <strong><em>ratified\n in both Lok Sabha and Rajya Sabha, by at least two thirds of members \npresent and voting, and by the legislatures of not less than half the \nstates<\/em><\/strong>.<\/p>\n\n\n\n<p><strong><em>Implications:<\/em><\/strong><\/p>\n\n\n\n<p>The 10% reservation will be in addition\n to the existing cap of 50% reservation for the Scheduled Castes, \nScheduled Tribes and the Other Backward Classes, taking total \nreservation to 60%. The quota targets the poor among the upper castes. \nThis will be over and above 50% mandated by Constitution and hence the \nneed for Constitution amendment Bill.<\/p>\n\n\n\n<p><strong><em>Supreme Court in Indira Sawhney case:<\/em><\/strong><\/p>\n\n\n\n<p>The proposed law would face roadblocks if challenged in the Supreme Court.<\/p>\n\n\n\n<p>A nine-judge Constitution Bench of the Supreme Court in the <strong><em>Indira Sawhney case of 1992<\/em><\/strong>\n specifically answered the question \u201cwhether backward classes can be \nidentified only and exclusively with reference to the economic \ncriterion.\u201d<\/p>\n\n\n\n<p>The constitution bench had categorically ruled that <strong><em>a backward class cannot be determined only and exclusively with reference to economic criterion<\/em><\/strong>.\n The bench had held that economic criterion may be a consideration or \nbasis along with, and in addition to, social backwardness, but it can \nnever be the sole criterion.<\/p>\n\n\n\n<p>The bench in its judgement declared <strong><em>50% quota as the rule unless extraordinary situations \u201cinherent in the great diversity of this country and the people\u201d happen<\/em><\/strong>.
